Terms and Conditions of Use
Customers of the car park should make themselves aware of the following terms of contract for use of this car park.
1.1 The 'Commissioners' shall mean The Crown Estate Commissioners of 16 New Burlington Place, London W15 3HX. The 'Customer' shall mean the driver of any vehicle using the Car Park.
1.2 'Vehicle' shall mean any vehicle entering the Car Park and shall include any mechanical or electric means of transport including accessories and anything attached to it or left in it or on it.
1.3 'Centre Manager' shall mean the Commissioners Shopping Centre Manager whose office is at Friary Walk, CrownGate, Worcester WR1 3LE
2.1 The Commissioners and their servants or agents will not be liable for the safety of any vehicle, its contents or otherwise provided by law and no servant or agent has authority to accept any liability on behalf of the Commissioners.
3.1. Customers shall keep vehicles properly secured at all times.
3.2. Valuable goods are left in the vehicle at the owner's risk.
4.1. The Car Park is normally open from 0800 hrs to 22.00 hrs Monday to Saturday and 0800 hrs to 1800 hours on Sunday.
4.2. Customers entering into this contract with the Commissioners for the parking of a vehicle at the Car Park, do so on behalf of themselves and all other persons using the Car Park with them or on their behalf and warrant their authority so to contract.
4.3. The Commissioners reserve the right to close the Car Park at any time, should it prove necessary or expedient to do so. They also reserve the right to refuse admission to any person or vehicle.
5. All parking charges are as displayed at the entrance to the Car Park and in the Car Park.
6.1. Vehicles may be removed only upon payment of the charge in accordance with the tariff displayed and may be detained unless such payment is made. The vehicle is subject to a lien for all parking charges due or accruing due from the Customer to the Commissioners. 'Lien' is a form of security interest granted over an item of property to secure the payment of debt.
6.2. If the lien is not discharged by the Customer within 28 days of parking of the vehicle by the Customer the commissioners may sell the vehicle in default of payment and the proceeds of sale shall be applied towards the satisfaction of all sums then owing to the Commissioners by the Customer, together with the expenses incurred in connection with the removal, storage and sale of the vehicle.
6.3. Any balance remaining after satisfaction of such sums shall be held by the Commissioners on behalf of the registered owner of the vehicle.
6.4. The Commissioners shall give the Customer not less than 7 days notice of their intention to sell the vehicle which notice shall be deemed to have been properly and sufficiently given by the sending of written notice by recorded delivery post, addressed to the registered owner at his last known address, whether or not the notice is actually received.
6.5. In the absence of the ticket issued on entry, the charge shall be calculated (as the tariff) from the time of car parking opening (09.00 am) to the time the vehicle owner wishes to leave, which must be tendered together with ownership of the vehicle.
6.6. In the absence of sufficient funds, the Customer may be requested to deposit security for payment.
6.7. Any vehicle remaining in the Car Park at the time the Car Park closes may not be removed by the Customer until the appropriate fee is paid.
7.1. The Customer shall use proper care and attention while in the Car Park and shall abide by any traffic or directional signs and notices displayed in the Car Park.
7.2. The Customer shall be responsible for any loss, damage or injury resulting from the movements of the vehicle in the Car Park or in the access or exit roadways and shall indemnify The Commissioners in respect of any such loss, damage or injury.
7.3. The Commissioners, their servants or Agents reserve the right to move or remove any vehicle as The Commissioners their servants or Agents deem necessary in the interests of safety and the efficient operation of the Car Park.
8.1. No service work, cleaning or repairs to a vehicle shall be carried out in the Car Park. In the case of breakdown, a qualified mechanic may carry out emergency repairs so far as necessary only for the purpose of moving the vehicle to a place at which permanent repairs can be undertaken.
8.2. No business activity in connection with the selling, hiring or other disposal of vehicles shall be carried on in the Car Park.
8.3. No charging or discharging of fuel tanks shall be undertaken in the Car Park or in the access or exit roadways.
9. No variation to these terms shall be effective unless in writing and agreed by The Commissioners in writing.
10. Any Customer having entered the Car Park who does not wish to abide by the above terms may use the ticket to exit from the Car Park forthwith, without incurring any fee.
